VACANCY OF PRESIDENT OF THE MENTAL HEALTH TRIBUNAL FOR SCOTLAND
Scottish Ministers invite applications from eligible candidates who are interested in appointment as President of the Mental Health Tribunal for Scotland (MHTS).
The MHTS was established by the Mental Health (Care and Treatment) (Scotland) Act 2003 and under that Act Scottish Ministers may appoint a President of the Tribunal to preside over the discharge of the Tribunal's functions.
Applicants should note that whilst the advertised post is for a President of the MHTS, under the terms of the Tribunals (Scotland) Act 2014 (the 2014 Act), the MHTS is a tribunal listed as one which will move into the First-tier Tribunal for Scotland. Upon this transfer, the Mental Health Chamber (MHC) will be established and the MHTS will be abolished. This transfer is scheduled to happen in late 2019, shortly after the successful applicant in this recruitment round is appointed and upon transfer the successful applicant will become President of the MHC.
The 2014 Act created a new simplified statutory framework for tribunals in Scotland, bringing existing tribunal jurisdictions together and providing a structure for new jurisdictions. The 2014 Act created two new tribunals, the First-tier Tribunal for Scotland and the Upper Tribunal for Scotland, known collectively as the Scottish Tribunals. The First-tier Tribunal for Scotland is grouped into subject specific chambers.
The key duties in this role will be to:
- provide leadership and management of the MHTS and, upon transfer, the MHC and to maintain and develop its reputation as an independent, accessible, professional and expert tribunal;
- upon transfer, contribute to the strategic development of the Scottish Tribunals, supporting the Lord President and the President of the Scottish Tribunals in their statutory responsibilities;
- be responsible on a day to day basis for the judicial quality, efficiency and smooth running of the MHTS/MHC, reporting to the President of the Scottish Tribunals after transfer and overseeing the operation of the MHTS/MHC and its members (ensuring that prior to transfer the President of the Scottish Tribunals is appropriately informed and consulted as necessary);
- ensure, on a day to day basis, the MHTS/MHC’s adherence to the relevant rules of procedure;
- provide such guidance to members in relation to the discharge of their duties as appears necessary or expedient;
- ensure that the Lord President’s guidance as to the Principles of Judicial Ethics is adhered to;
- have regard to the welfare of the members of the MHTS/MHC and ensure that any policies issued by the Judicial Office for Scotland on behalf of the Lord President in respect of welfare are adhered to;
- represent the MHTS/MHC at conferences, official functions and other meetings;
- manage and develop specialist training for members of the MHTS/MHC and adhere to any arrangements the Lord President has put in place for the training of members of the Scottish Tribunals; and
- ensure that judicial standards are maintained and that public confidence in the MHTS/MHC remains high.

About the appointment
The fee for the role of MHTS President (and upon tranfer MHC President) is £550 per day.
Travel and subsistence expenses will also be met.

Hamilton Business Park
Applicants should also note that some travel throughout Scotland may be required in this role.
It is expected that the President will, each month, commit at least 10-15 days to the role.
