Appointment of Lay Chairing Member

Scottish Ministers are looking to appoint a new Lay Chairing Member to the Judicial Appointments Board for Scotland (JABS).  The Lay Chairing Member must be resident in Scotland and must not be a member or former member of the judiciary or a practising advocate or solicitor in Scotland.

JABS is an advisory body that plays a key role in ensuring an open and transparent selection process based on merit for specific judicial appointments. 

The Board’s functions are:

  • to recommend to Scottish Ministers individuals for appointment to judicial offices within the Board’s remit, and

  • to provide advice to Scottish Ministers in connection with such appointments.

We are looking to appoint a Lay Chairing Member who will:

  • establish and maintain good working relationships (while safeguarding the Board’s independence) with the First Minister and senior Scottish Government officials, the Lord President and the President of the Scottish Courts and Tribunals Service. The Lay Chairing Member will have contact with counterparts in the Judicial Appointments Commission (for England and Wales) and the Northern Ireland Judicial Appointments Commission;

  • lead on regular liaison meeting with other stakeholders, such as the Faculty of Advocates, Law Society of Scotland, Sheriffs’ Association and similar representative bodies;

  • participate in the Board’s decision-making on the suitability of individual candidates for judicial appointment;

  • be responsible for leading the strategic development of the Board, monitoring and reviewing the Board’s strategic direction and its policies and procedures and overseeing its operation; and

  • contribute to the development and review of the Board’s policies.

Time Commitment

The total time commitment expected from the Lay Chairing Member may vary significantly year on year and within any given year. The upper time commitment will typically be around 50 days per year. This would include preparation time. One of the most significant factors affecting time commitment will be the number and nature of the recruitment exercises in which you participate in during any particular year. This typically will require a number of consecutive days, the Board will discuss this with you.[1] The Lay Chairing member will need to be flexible with their time – the work is demand led and can occasionally require finding time to allocate to a recruitment round with only a few weeks’ notice.  Potential applicants should not be dissuaded by the upper estimates of time commitment. It will be for the Lay Chairing Member in consultation with the other Board Members and the Chief Executive to establish the detail of a workable and sustainable time commitment.

[1] A large scale appointment round may involve sifting applications at home for a period of up to 2 weeks within a four week period,  a couple of days on planning and preparation and an interview period of up to two weeks. In total this might take in the region of 10 consecutive days.  The smallest scale exercises can amount to a day of sifting, a day of planning and preparation and a day of interviews.


Members receive £350 per day.  Expenses incurred as a result of carrying out the duties of the appointment, including reasonable travel and subsistence costs and dependant carer and childcare expenses, will be reimbursed.

The appointment is non-pensionable.

Length of the Appointment

The term of appointment will be for up to 4 years.  There is the possibility of reappointment subject to evidence of effective performance and having regard to the skills, knowledge, understanding and experience required by the Board at the time.  Any appointments and subsequent reappointments will not extend beyond a maximum of eight years.
